Organizations (warehouses) that carry out storage of goods as a business activity and provide services related to storage may be insurer.
OBJECT OF INSURANCE
The object of insurance is the property interests of the Insurer which are not contradicting the legislation of the Republic of Tajikistan, associated with his obligation to reimburse the Beneficiaries in the manner prescribed by the Civil Code of the Republic of Tajikistan, real property damage caused by the loss, shortage or damage to goods accepted for storage.
The insurer provides insurance protection in the event that the Beneficiaries present to the Insured the property claims declared in accordance with and on the basis of the current civil legislation for compensation for losses caused during the term of the insurance contract due to sudden, unforeseen and unintentional reasons in the course of the Insurer’s professional activities as a custodian.
INSURANCE EVENT
An insurance event is an event that occurred during the period of validity of the insurance contract, with the occurrence of which the Insurer is obliged to pay insurance compensation.
Insurance events include events that occurred in connection with the implementation by the Insurer of the storage of goods transferred to him by the goods owners, exclusively within specially allocated and equipped premises, open areas or other places owned by the Insurer (on the right of ownership or right of lease), intended for storage and specified in the insurance contract, if such storage is carried out by the Insurer without transferring things for storage to a third party, even if in the same warehouse.
An insurance event is the occurrence of the obligation of the Insurer by virtue of the civil legislation of the Republic of Tajikistan to compensate for real property damage caused to the Beneficiaries due to loss, damage or shortage of goods accepted from the Beneficiaries for storage, expressed in the presentation of justified property claims or a court decision confirming the occurrence of the above obligation.
